State of Ohio Forms
First...you will be given a copy of any document you're asked to sign. The following two forms must be signed at our first meeting, before I can begin showing you houses.
The State of Ohio Requires that you receive and sign for a copy of the Consumer Guide to Agency Relationships. The form explains the different types of agency relationships you can enter into with a real estate professional. For our purposes, I will represent you either as a Buyer's Agent if I'm working with you to find you your new home or as a Seller's Agent, if I'm representing you in the sale of your home.
Howard Hanna does allow Dual Agency, but I prefer to represent one client at a time. If you choose to purchase one of my listings, I will be representing the seller in that instance, however, I strive to be fair and honest to all parties involved. The most important consideration is confidentiality which we will discuss in greater detail.
The other form is Our Agency Commitment - this form is now voluntary, and it reviews in writing what we've discussed over the phone before actually meeting; i.e., the style of the home, number of bedrooms and baths, 1st floor family room and/or finished basement, garage size, etc. The most important reason for the form is AREAS in which you'd like to search. If you tell me you want to purchase a home in Willoughby Hills and I keep showing you homes in University Heights, then that's a Fair Housing Violation. I'm a strong proponent for Fair Housing and if your budget and pre-approval supports the cost of a home in Willoughby Hills, or Hunting Valley, or Mayfield Heights - wherever you wish, then those are the areas I will show you. If your budget doesn't quite allow the cost of those homes, then we will discuss it and I'll advise you which areas would be more likely to have homes in your price range.
"Our Agency Commitment" also covers price range and whether you've been pre-approved for your mortgage loan or not. I can provide you with a list of 10-12 reputable mortgage lenders - if you tell me you'd like my representation.
Neither form is a contract nor obligates you in any way - you have my word on that!...and my word is my bond, always! Our relationship is non-exclusive and either of us can terminate it at anytime, without cause. If you have access to email (at the time we speak), I will email the forms to you for signature or request you sign them at our first meeting...that's a state requirement.
